Definitions

“You” are defined as any User who chooses to engage with surgeworlds.com.

“We”, “Us”, “Our”, “Surge Worlds”, and “Warped Tree” are all terms that define the team of admins and owners of surgeworlds.com.

Eligibility

This Terms Of Service (TOS) is used to establish that You are:
-At least 13 Years of Age
-Have the Legal Capacity to enter agreements
-Are willing and able to comply with United Stated Federal, and local, laws.

Acceptance of Terms

Terms

By accessing or using surgeworlds.com (the “Service”), you acknowledge that you are legally eligible to do so and agree to be bound by these Terms of Service.

Ownership & Use of Content

All content made available through the Service—including but not limited to the SURGE! TTRPG system, rulesets, mechanics, character sheets (printable, fillable, or digital), items, species, spells, abilities, creatures, NPCs, worldbuilding content, adventures, tools, branding, and other materials (collectively, “Content”)—is owned by or licensed to Surge Worlds and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Content for personal use, gameplay, commentary, review, and public performance, including monetized streaming or recorded actual-play content, provided that the Content itself is not redistributed, resold, or republished.

Restrictions

You may not, without prior written authorization from Surge Worlds:

  • Copy, reproduce, redistribute, republish, or rehost Content
  • Sell, sublicense, or commercially exploit Content
  • Present the Content as your own or as part of another system
  • Distribute Content in whole or in substantial part, whether for free or for profit

This restriction applies to all formats, including digital, print, and derivative reproductions.

Permitted Use

Nothing in these Terms prohibits:

  • Playing the SURGE! TTRPG
  • Creating original characters or campaigns for personal use
  • Sharing character information within a private gaming group
  • Referencing rules during gameplay

Description of the Service

Surge Worlds (“we,” “us,” or “our”) provides an online platform located at surgeworlds.com (the “Service”) dedicated to supporting and publishing content related to the SURGE! tabletop role-playing game (TTRPG) and associated worlds, tools, and community resources.

The Service may include, but is not limited to:

  • A publicly accessible wiki containing SURGE! rules, mechanics, reference material, and worldbuilding content
  • Printable, fillable, and/or digital character sheets and gameplay aids
  • Original items, species, spells, abilities, creatures, NPCs, adventures, and setting materials
  • Community-facing tools or resources related to gameplay, character creation, or campaign management
  • Downloadable or viewable digital assets and reference materials
  • News, updates, development notes, and informational content related to SURGE!
  • Experimental, prototype, or beta features that may change or be discontinued without notice

The Service is provided primarily for gameplay, reference, creative expression, and community engagement. Content made available through the Service may evolve over time as rules are refined, features are added or removed, or materials are updated.

We do not guarantee that any part of the Service will be uninterrupted, error-free, or permanently available. We reserve the right to modify, suspend, or discontinue any aspect of the Service, including specific features or content, at any time and without prior notice.

Access to the Service does not grant users any ownership interest in the Service or its Content beyond the limited rights expressly described in these Terms.

User Conduct

By accessing or using the Service, you agree to use Surge Worlds in a lawful, respectful, and responsible manner. You are solely responsible for your conduct and any content you submit, post, or share through the Service.

You agree not to engage in any of the following prohibited activities:

Prohibited Conduct
  • Harassing, threatening, abusive, defamatory, hateful, or discriminatory behavior toward others
  • Impersonating another person, group, or entity, or misrepresenting your affiliation with Surge Worlds
  • Posting or transmitting content that is unlawful, obscene, malicious, or otherwise inappropriate
  • Uploading or sharing content that infringes upon the intellectual property rights of others
  • Attempting to exploit, disrupt, or interfere with the Service, including through hacking, scraping, data mining, or circumvention of safeguards
  • Introducing malware, viruses, or other harmful code
  • Using the Service for fraudulent, deceptive, or illegal purposes
  • Attempting to access accounts, systems, or data that you are not authorized to access
Community Use

Surge Worlds is intended to support creative expression, gameplay, and collaboration. While debate and critique are welcome, users are expected to engage in good faith and with respect for others. We reserve the right to moderate content and behavior to maintain a safe and constructive environment.

Enforcement

We reserve the right, but do not have the obligation, to:

  • Review, monitor, or remove user-submitted content
  • Restrict, suspend, or terminate access to the Service for violations of these Terms
  • Take appropriate action, including reporting to relevant authorities, when required by law
No Expectation of Moderation

You acknowledge that Surge Worlds is not responsible for monitoring all user activity and that use of the Service is at your own risk. We make no guarantees regarding the accuracy, quality, or appropriateness of user-generated content.

User-Generated Content

The Service may allow users to create, submit, post, or otherwise share content, including but not limited to character information, homebrew material, comments, or other creative works (“User Content”).

You retain ownership of any User Content you create and submit through the Service. By submitting User Content, you grant Surge Worlds a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute such User Content solely for the purpose of operating, promoting, and improving the Service.

You represent and warrant that:

  • You own or have the necessary rights to submit the User Content
  • Your User Content does not infringe the rights of any third party
  • Your User Content complies with these Terms

We reserve the right, but not the obligation, to remove or modify User Content at our discretion.

Intellectual Property Rights

All content and materials provided through the Service, including the SURGE! TTRPG, rules, mechanics, text, artwork, design elements, logos, trademarks, character sheets, tools, and branding (“Surge Worlds IP”), are owned by or licensed to Surge Worlds and are protected by intellectual property laws.

Except as expressly permitted in these Terms, no rights are granted to copy, modify, distribute, sell, or create derivative works based on Surge Worlds IP without prior written authorization.

Nothing in these Terms transfers ownership of Surge Worlds IP to users.

Streaming, Recording, and Actual Play Content

Surge Worlds expressly permits the use of the SURGE! TTRPG and related Content in live-streamed, recorded, or otherwise publicly performed gameplay, including monetized content such as streams, videos, podcasts, and reviews.

This permission applies provided that:

  • The Content is used as part of gameplay, commentary, or review
  • The Content itself is not redistributed or republished in full
  • No implication is made that such content is officially endorsed by Surge Worlds unless expressly authorized

Attribution is appreciated but not required.

Character Sheets, Downloads, and Tools

Character sheets, tools, and downloadable materials are provided “as is” for gameplay and reference purposes. We make no guarantees regarding compatibility, accuracy, or continued availability.

You are responsible for maintaining backups of any data you create or store using the Service. Surge Worlds is not responsible for loss of data, characters, or campaign information.

Third-Party Services and Links

The Service may include links to or integrations with third-party platforms or services. Surge Worlds is not responsible for the content, policies, or practices of third-party services, which are governed by their own terms.

Your interactions with third-party services are solely between you and the third party.

Disclaimers

The Service and all Content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Surge Worlds disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, error-free, or free of inaccuracies.

Limitation of Liability

To the fullest extent permitted by law, Surge Worlds shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the Service, including loss of data, loss of enjoyment, or campaign disruption.

In no event shall Surge Worlds’ total liability exceed the amount you paid to access the Service, if any, during the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Surge Worlds from and against any claims, liabilities, damages, losses, and expenses arising out of or related to:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms or applicable law

Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to the Service or community.

Upon termination, your right to access the Service will immediately cease.

Modifications to the Terms

We may update these Terms from time to time. Changes will become effective upon posting to the Service. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Surge Worlds operates, without regard to conflict of law principles.
